TERMS AND CONDITIONS – RENTAL AGREEMENT This Rental Agreement (“Agreement”) is entered into between the RENTER/DRIVER(S) (“Customer”) and the COMPANY (“Owner”) for the rental of a motor vehicle (“Vehicle”). By signing this Agreement, you acknowledge, accept, and agree to all terms and conditions listed below. ________________________________________ 1. AUTHORIZED USE The Vehicle may only be used by Authorized Drivers: 1. The primary RENTER/DRIVER(S) listed on the contract; and 2. Additional drivers approved and recorded by the COMPANY. Unauthorized use includes, but is not limited to: • Operation by an unlisted driver • Off-road use or unpaved roads • Towing or pushing anything • Racing, testing, or commercial hire • Illegal activities • Operation while impaired by alcohol or drugs • Intentionally damaging the vehicle • Taking the vehicle outside Puerto Rico • Obtaining the vehicle under false pretenses Any prohibited use constitutes breach of contract and may result in additional fees, including costs, penalties, and up to $2,500 breach-of-contract fee (see Section 15). ________________________________________ 2. RATES, TAXES & SURCHARGES Included in Basic Rates • Unlimited mileage (fair usage policy applies) • Local taxes (11.5%) • Airport/location surcharge including airport shuttle (10.5%) Not Included in Basic Rates • Public Liability Insurance (PLI) • PDW, LDW, CDW • Theft Waiver • Roadside assistance for driver-caused issues • Fuel, tolls, key replacement, smoking fees • Additional driver fees • Child seats, tire insurance, glass insurance • Facility Fee • Energy Fee • License Fee • Trip Fee ________________________________________ 3. INSURANCE REQUIREMENTS & COVERAGE The COMPANY provides only the legally required insurance under Puerto Rico law. No optional coverage is included unless purchased at the counter. 3.1 Public Liability Insurance (PLI) • Not included in base rate • Available at $21.99/day + tax • Renter may decline ONLY with acceptable proof of personal insurance 3.2 PERSONAL INSURANCE REQUIREMENTS (NEWLY ADDED REQUIREMENTS) Your personal insurance must meet ALL of the following criteria to be accepted: 1. We do NOT accept insurance policies that ONLY provide liability coverage. 2. Insurance must explicitly state that it provides full collision and comprehensive coverage for rental vehicles in Puerto Rico. 3. Collision coverage must cover the full book value (actual cash value) of the rented vehicle, and: o This must be confirmed in writing on an official letter from the insurer. 4. Proof of insurance must be verified and approved by the COMPANY. 5. Credit card insurance is not accepted under any circumstance. If acceptable proof is not provided, renter must purchase PDW or LDW. 3.3 Theft Waiver Limits renter liability up to a maximum vehicle value of $90,000 USD. 3.4 Collision Damage Waiver (CDW) Not included. Excludes damage to: • Glass, tires, roof, undercarriage, interior • Keys, fobs, plates, documents, tools, etc. • Negligent or reckless driving • Unauthorized drivers 3.5 Partial Damage Waiver (PDW) Optional; deductible: $300–$800 depending on vehicle class. 3.6 Loss Damage Waiver (LDW) Optional; excludes the same items as CDW. 3.7 Roadside Assistance Roadside Assistance is available ONLY during the COMPANY’s normal hours of operation. If a mechanical issue, breakdown, lockout, flat tire, or any other problem occurs outside of business hours, the RENTER must: 1. Call 911 in the event of any emergency or unsafe situation. 2. Secure the vehicle safely and wait until the COMPANY reopens. 3. The COMPANY will address and resolve the issue the following business day during operating hours. Included vs. Not Included • Mechanical breakdowns not caused by renter negligence are included at no cost during operating hours. • Driver-caused issues (e.g., misfueling, dead battery, tire damage, lost keys, lockouts, accidents due to fault) are not covered and may incur additional fees. • Optional Roadside Assistance for driver-caused issues is available during operating hours at $12.99/day + tax. After-Hours Limitation The COMPANY does not provide emergency response, towing, or on-site support outside business hours. The RENTER is responsible for safety decisions made after hours, including contacting authorities or emergency services when appropriate. ________________________________________ 4. TOLLS / AUTOEXPRESO All vehicles are equipped with a registered AutoExpreso device. Toll Service Package • $14.99/day including tolls + tax • One-time $19.99 activation fee + tax Declining the Package If you decline the package: • You will be charged posted toll rate + $60 service fee per toll + tax Tampering Removing, damaging, or disabling the device results in: • $500 replacement fee + tax, • $60 per toll transaction, • plus any applicable fines. ________________________________________ 5. DRIVER REQUIREMENTS • Minimum age: 25 • Maximum age: 75 • Valid driver’s license held at least 1 year • International Driving Permit required if license not in Latin alphabet Identification Requirements Visitors: • Passport • Valid driver’s license (translation if needed) • Credit card in renter’s name Local Renters: • Government-issued ID • Valid driver’s license • Credit card in same name • Proof of billing address ________________________________________ 6. VEHICLE CONDITION, RETURN & FEES Vehicle must be returned: • In identical condition (normal wear permitted) • At agreed date/time/location • With same fuel level Additional Fees • Cleaning fees: $150–$750 + tax • Smoking fee: $500 + tax • Pet fee (except approved service animals): $500 + tax • Key fob replacement: $500 minimum + reprogramming costs • Tire blowout: $250 per tire • Towing: $350 + expenses • Violations: ticket cost + $75 admin fee • Fuel: $9.99/gal + $75 admin fee + tax ________________________________________ 7. RESERVATION, CANCELLATION & NO-SHOW POLICY (UPDATED) Cancellation (Updated Rule) If reservation is canceled within 48 hours of pickup: → Customer forfeits any deposit or prepaid amount. Cancellations made more than 48 hours before pickup → Full refund of prepaid amounts. No-Show → Reservation is non-refundable. ________________________________________ 8. EXTENSION POLICY • 48+ hours notice: standard daily rate applies • Less than 48 hours notice: $100 late extension fee + daily rate • Subject to availability ________________________________________ 9. TRACKING & REPOSSESSION The COMPANY may track, monitor, disable, or repossess the Vehicle at any time, without notice, at renter’s expense if: • Payment is overdue • Vehicle appears abandoned • Contract is violated • Illegal activity is suspected Renter pays all associated costs. ________________________________________ 10. ACCIDENTS & INCIDENT REPORTING In the event of an accident, breakdown, or unsafe condition: 1. Move the vehicle to a safe area if possible. 2. Activate hazard lights. 3. If there is immediate danger or injury, call 911 immediately. 4. If after business hours, secure the vehicle and notify the COMPANY once it reopens. 5. During business hours, contact the COMPANY for assistance. 6. Complete all required accident or incident reports when requested. Failure to follow these steps may void optional protections and may be considered reckless misconduct. ________________________________________ 11. RELEASE OF LIABILITY – VEHICLE USE (NEW) By signing this Agreement, the RENTER/DRIVER(S) expressly releases and holds harmless the COMPANY, its owners, employees, agents, and affiliates from any and all liability, claims, losses, injuries, damages, or expenses arising from: • Use or operation of the rented vehicle • Personal property loss • Accidents or collisions • Weather, road, or environmental conditions • Acts of third parties This release applies unless prohibited by Puerto Rico law. ________________________________________ 12. RELEASE OF LIABILITY – SHUTTLE SERVICE (NEW) By boarding, using, or riding the COMPANY shuttle, the Customer agrees: • The COMPANY is not responsible for accidents, delays, injuries, personal property loss, or any harm occurring while entering, riding, or exiting the shuttle. • Customer uses the shuttle at their own risk. This is a full and binding release of liability to the extent permitted under Puerto Rico law. ________________________________________ 13. EARLY RETURN POLICY No refunds are issued for unused rental days. ________________________________________ 14. MAXIMUM RENTAL PERIOD Maximum rental length is 28 days. ________________________________________ 15. BREACH OF CONTRACT FEE Any violation of this Agreement—including but not limited to unauthorized drivers, geographic violations, tampering with tracking devices, misuse of the vehicle, toll fraud, or fraudulent insurance documentation—may result in: • A breach-of-contract penalty up to $2,500, • Plus all actual damages, fees, recovery costs, lost revenue, and legal expenses. ________________________________________ 16. RIGHT TO MODIFY TERMS The COMPANY reserves the right to change, update, or modify these Terms and Conditions at any time, without prior notice. The version in effect at the start of the rental period applies. ________________________________________ 17. GOVERNING LAW This Agreement shall be governed by and interpreted exclusively according to the laws of the Commonwealth of Puerto Rico. Any disputes shall be resolved under the jurisdiction of Puerto Rican courts. ________________________________________ 18. GENERAL PROVISIONS • No oral modification is valid; changes must be in writing and signed. • Customer is responsible for all fees up to the point the vehicle is formally inspected and accepted by the COMPANY. • Customer agrees to reimburse COMPANY for all collection, legal, and repossession costs. • COMPANY makes no expressed or implied warranty as to vehicle condition or fitness. • Customer property is not insured; COMPANY is not responsible for lost or stolen items. • Hours of Operations are from 8am to 6pm from Monday to Sunday. We may close during holidays. 19. PRIVACY & DATA RETENTION POLICY (NEW) 19.1 Collection of Information The COMPANY collects and maintains personal information provided by the RENTER/DRIVER(S), including but not limited to: • Driver’s license information • Passport or identification documents • Billing address and contact information • Credit card authorization forms • Insurance documentation • Rental history and contract details • GPS or telematics data related to the rented vehicle This information is collected for business and legal purposes, including fraud prevention, contract enforcement, insurance claims, payment processing, and regulatory compliance. ________________________________________ 19.2 Data Retention The COMPANY may store, retain, and maintain the RENTER/DRIVER(S)’s personal and rental-related information for up to one (1) year after the end of the rental period. This retention period is necessary to: • Process delayed tolls, fines, violations, and government penalties • Resolve insurance claims or disputes • Address chargebacks, fraud, or legal matters • Recover unpaid balances or damages • Comply with Puerto Rico laws and business record requirements After one year, personal information will be deleted or anonymized unless lawfully required to be retained longer. ________________________________________ 19.3 Post-Rental Charges (New Requirement) The RENTER acknowledges and agrees that charges may appear on their account up to one (1) year after the vehicle is returned, including but not limited to: • Tolls and toll violations • Parking violations and traffic citations • Damages discovered after cleaning and inspection • Roadside assistance or towing charges • Key replacement or equipment costs • Cleaning fees • Administrative fees • Insurance, claim, or subrogation-related charges • Breach-of-contract penalties • Fuel charges discovered after inspection These charges may be processed automatically using the payment method on file. RENTER authorizes the COMPANY to retain payment authorization for this purpose during the one-year retention period. ________________________________________ 19.4 Data Sharing The COMPANY may share relevant personal information with: • Law enforcement • Insurance carriers • Toll authorities (AutoExpreso) • Collection agencies • Legal representatives • Merchant processors • Government agencies Such sharing is strictly for lawful business purposes, including contract enforcement, fraud prevention, and claims processing. ________________________________________ 19.5 RENTER Consent By signing this Agreement, the RENTER/DRIVER(S) acknowledges, understands, and consents to: • The retention of personal and rental information for up to one year • The possibility of charges after the rental period • The COMPANY’s right to process delayed or pending charges • The COMPANY’s right to disclose information for lawful or contractual purposes
